Common Law

Ruben Alvarodo

A Common Law will restore to your understanding a view of history that corresponds with the historical reality and the baseline tradition of Western civilization. It will explain to you how Israel, Greece, and Rome were combined to form a new civilization, founded among the Germanic tribes of Europe, based in liberty under law and open to the spontaneous generation of an associationalism unparalleled in the history of the world. Western civilization produced a truly pluralistic social order with countless centers of autonomy, because it is oriented to a covenantalism combining liberty and authority, transcendence and immanence, commitment and consent, obligation and self-determination.

It will also explain to you the central importance of neglected chapters in European history: the rise of the Dutch Republic, the story of Spain's School of Salamanca, and the central importance of the Holy Roman Empire of the German Nation.

It will then show you how the legacy of Christian civilization in the West was stolen by humanists through the Enlightenment, who placed liberty under law upon an altogether different, and unstable, foundation – the foundation of the autonomous individual. In so doing, the humanists were able to wrest civilizational control away from the church – but only to deliver it into the hands of the radical communitarians, beginning with Rousseau – and we still live in the throes of that great misdeed.
